Please read these Terms and Conditions (“Terms”) carefully before using makanahele.com (the “Site”) or purchasing any products from Makanahele Creations (“we,” “us,” “our”). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.

1. About Us

Makanahele Creations is a print-on-demand business offering home décor and apparel featuring original designs. Products are also available through our Etsy and eBay storefronts, in addition to this Site.

2. Print-on-Demand & Order Fulfillment

All products are made to order through third-party print-on-demand fulfillment partners, including Printify and its network of production partners. This means:

Items are not stocked in advance; each order is produced individually after purchase.
Because products are custom-made to order, all sales are final except as described in Section 6 (Returns, Exchanges & Defects).
Production and shipping times are estimates provided by our fulfillment partners and are not guaranteed. Delays with production partners, carriers, or customs (for international orders) are outside our direct control.
Colors, sizing, and print placement may vary slightly from what is shown on screen due to differences in monitors, printing processes, and materials.

3. Orders & Payment

By placing an order, you confirm that all information provided (shipping address, contact details, payment information) is accurate and complete.
We reserve the right to cancel or refuse any order at our discretion, including in cases of suspected fraud, pricing errors, or unavailability of a design or product.
Prices are listed in U.S. dollars and include the cost of shipping unless otherwise noted at checkout.
Applicable sales tax will be calculated and added at checkout where required by law.

4. Shipping & Delivery

Orders are shipped directly from our fulfillment partners’ production facilities, which may result in multiple packages for orders containing different product types.
Estimated delivery times will be provided at checkout or in your order confirmation, but are not guaranteed.
We are not responsible for delays caused by shipping carriers, customs processing, incorrect address information provided by the customer, or events outside our control.
Risk of loss and title for products purchased pass to you upon our delivery to the shipping carrier.

5. International Orders

International customers are responsible for any customs duties, import taxes, or fees imposed by their country. These charges are not included in the item price or shipping cost and are the sole responsibility of the recipient.

6. Returns, Exchanges & Defects

Because all items are custom made to order, we are unable to accept returns or exchanges for reasons of buyer’s remorse, incorrect size selection, or change of mind.

However, we want you to be happy with your order. If your item arrives:

Damaged in transit,
Defective or with a significant printing/production error, or
Materially different from what was ordered (wrong item or design),

please contact us within 14 days of delivery with your order number and photos of the issue, and we will work with our production partner to arrange a replacement or refund at our discretion.

7. Intellectual Property

All original designs, artwork, photographs, and content on this Site are the property of Makanahele Creations and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our designs or content without our express written permission.

Purchasing a product does not transfer any ownership of the underlying design or artwork to you.

8. User Conduct

When using this Site, you agree not to:

Use the Site for any unlawful purpose;
Attempt to interfere with the Site’s security or functionality;
Submit false or misleading information; or
Infringe upon the intellectual property or rights of others.

9. Disclaimer of Warranties

Products are provided “as is.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that colors, fit, or materials will exactly match your expectations based on product photos, given the nature of print-on-demand production.

10. Limitation of Liability

To the fullest extent permitted by law, Makanahele Creations shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of our products. Our total liability for any claim shall not exceed the amount you paid for the applicable order.

11. Third-Party Platforms

If you purchase through Etsy, eBay, or another third-party marketplace, that platform’s own terms of service, buyer protection policies, and dispute resolution processes will also apply to your transaction, in addition to these Terms where applicable.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Hawaiʻi, without regard to conflict of law principles, unless otherwise required by applicable consumer protection law in your jurisdiction.
